BIRMINGHAM, Ala. (WBRC) - An Alabama company denied an integrated license by the Alabama Medical Cannabis Commission (AMCC) asked a judge Tuesday, Sept. 17, to permanently throw out all three of the AMCC’s attempts to issue licenses in the category, and declare the AMCC’s appeal process void.

Alabama Always LLC is one of the plaintiffs suing the AMCC, alleging the commission violated the state’s Open Meetings Act as well as the Alabama Administrative Procedures Act during three failed attempts to score applicants and issue licenses in the biggest category for medical cannabis producers. After a status hearing last week in Montgomery Circuit Court, Alabama Always and several other plaintiffs said they believed the judge overseeing multiple lawsuits against the AMCC was inviting plaintiffs to file a motion for partial summary judgement, a sentiment with which the AMCC’s attorneys strongly disagreed.

The Alabama Court of Civil Appeals rejected a bid last Friday by the AMCC to dismiss challenges to medical marijuana licenses in December.

The ruling touching on jurisdictional issues was highly technical, but the upshot is that companies that sued the AMCC can continue making their case in front of a Montgomery County Circuit Court judge.
