Scrap metal business suing city of Birmingham over business license

BIRMINGHAM, AL (WBRC) - A scrap metal business is taking the city of Birmingham to court after the city rejected the company's license application. The company believes the city is playing politics.

Jordan Industrial Services, Inc. wants to open up a scrap metal processing business just off Finley Boulevard.

But in March, the city denied the company's license to operate saying the operation would pose safety hazards to the community. A number of people also say they don't want it in their backyard.

"Not only recycling, they burning over there too. It be that gray smoke. It smell up the whole neighborhood. You can't breathe. It get on your clothes. It gets on your body. You can't come outside. I walk every day. I'm unable to walk in my community now. I can't even sit on my back porch now," said Catherine Evans, Vice President of the Acipco-Finley Neighborhood Association.

In its lawsuit, Jordan Industrial Services says it has met all requirements to operate and wants the city to perform its legal obligation and issue a business license.

We're still waiting to hear back from the city and company on this new lawsuit.
