BIRMINGHAM, Ala. (WBRC) - UPDATE: The death of a man in a Birmingham parking structure on September 29 has been ruled justifiable by the Jefferson County District Attorney.

The Birmingham Police Department presented information gathered in this case to the Jefferson County District Attorney’s office for review.

After review, the DA ruled the shooting was justifiable. The police have reclassified the investigation as a justified death investigation.

Officials now say the Birmingham Police Department is investigating 106 murders so far in 2022, including 7 justifiable death investigations.

ORIGINAL STORY: Birmingham Police officers are investigating a shooting death Thursday afternoon.

It happened around 4:02 p.m. in the 2600 block of 5th Avenue South.

Officers responded to a call of a person shot. A victim was found inside the fence of the Parking Enforcement Building suffering from a gunshot wound. He died at the scene. He has been identified as 29-year-old Adarius Jamar Peterson.

Officers said the victim was involved in a verbal altercation with a parking enforcement employee and the argument escalated into a shooting.

One person, who officers called a tow truck driver, is in custody for questioning.

Officers said they believe the victim had a car at the lot.
