Dog shot by jogger after escaping home

DELTONA, FL (WKMG/CNN) - A rescue dog named Lucky was killed by a jogger who said the dog was threatening him.

The dog escaped the home of owner Nancy Harmon, and a 42-year-old man jogging by the home pulled out a gun and killed the dog.

"The man just pulled out his gun and shot her, just like that," Harmon said. "She ran out the door and got as far as the street, and he shot her."

The bullet hit the dog in the neck, and Lucky is now buried in Harmon's back yard.

Harmon's neighbor, Susan Munoz, said the dog was not vicious, and she's more concerned about someone carrying a gun down the street.

"She was very protective over the land," Munoz said. "She was rarely ever loose."

The man has a license to carry the gun and called 911 to report the incident.

"I got a situation where a dog just attacked me, and I had to shoot him," the man said on the 911 call. "I sat there, I was in fear of my life and he came towards me."

Harmons is afraid another shooting could happen and wants the jogger held accountable.

"She never bit anybody or harmed anybody," Harmon said. "She was just a pet dog."

Deputies say no charges will be filed, at least for now, because the man said he felt threatened and has a license to carry.

"They should take your permit away," Harmon said. "If you're just jogging and everyone is mostly seniors and you take a gun out and shoot a dog, I really think something should be done about it. I don't think you should have a gun because the next person might be a child."
