AL Supreme Court removes judge from Victoryland case

TUSKEGEE, AL (WSFA) -

It's a big win for Alabama Attorney Luther Strange's office. Officials say Circuit Judge Tom Young has been removed from the case involving the seizure of machines and cash from Victoryland in Macon County.

Attorney General Strange had previously filed a motion to have a new judge assigned to the case arguing that the judge was prejudiced for Victoryland and against the State.

The Alabama Supreme Court removed Young from the case saying he has a history of not obeying the high court. The state's highest court, controlled by all Republicans, agreed Young should be taken off the case.

Back in February 2013, Alabama State Troopers raided Victoryland on a warrant the high court ordered Young to sign. Young had previously refused to sign a warrant.

Attorneys for Victoryland's owner Milton McGregor argued that the attorney general was attempting to "judge shop" to have someone who would favor them on the case.

While McGregor's attorney are disappointed in the order, they say they still want their day in court.

Now that Judge Young is no longer over the case, it will likely go to another judge within that circuit. There are three judges who could hear the case in the region, but it will most likely go to the senior judge in the circuit, Judge Martin, or to Judge Perryman.

Victoryland has fought the state of Alabama for several years regarding the legality of its machines. It says they're legal electronic bingo machines. The state says their illegal slot machines.
