One of the charges against a 35-year-old mother accused of leaving her son in a car for hours has been dismissed.
Attorney for Katherine Papke, Jim Sturdivant, says the charge for leaving a child unattended in a vehicle was dismissed earlier today.
As we reported earlier this week, Papke's four-month-old son died after being left in her minivan for hours after she forgot to drop him off at daycare.
Sturdivant says the charge was dropped because under the new law it only applies to paid caregivers.
At this time he has not filed a motion to dismiss the manslaughter charge.
He tells FOX6 he wants to further investigate that charge and hopes to talk to the district attorney about it.
