LEEDS, AL (WBRC) -

A judge has decided that more than 30 Rottweiller dogs belonging to an owner in Leeds will be euthanized after two of the owner's dogs mauled an elderly man to death last month.

Donald Thomas, 83, was killed when two of his neighbor's Rottweiler dogs attacked him while he was checking his mail at his home on Sept. 20. Leeds police shot and killed the two dogs when they became threatening toward an officer as he approached the scene.

According to court documents, Thomas' body was found on the dogs' owner's property.

The remaining 33 dogs, all Rottweilers or Rottweiler mixes, were picked up by the Birmingham Jefferson County Animal Control following the deadly attack. The BJCAC performed mental and physical evaluations of each animal and presented their findings to the St. Clair County District Attorney.

St. Clair County District Judge Alan Furr ruled Tuesday, Oct. 2 that all 33 of the owner's remaining dogs should be humanely euthanized. Judge Furr based his decision on the testimony of Leeds Police Investigator Rhiannon Holman, who described the extent of Thomas' injuries, saying the Rottweilers who attacked him chewed the skin and flesh from his legs. Holman also spoke about the aggressive behavior displayed by the remaining dogs during the removal process.

The attorney for the dog owner said the owners didn't want the seized dogs back, due in part to what happened. They still, however, deny any wrongdoing.

So far, no charges have been filed in the case.
