Man sentenced for identity theft

BIRMINGHAM, AL (WBRC) – A Birmingham man has received more than three years in prison for using a telephone scam to obtain personal identification information.

37-year-old John Edward Herring was sentenced on Thursday to three years and four months by U.S. District Judge Virginia E. Hopkins.

Prosecutors say Herring was using the information to steal Social Security benefits. Herring plead guilty in October to charges of Theft of Government Property and Aggravated identity Theft. He also received a penalty from having his probation revoked in a similar case from 2007.

Herring will also pay more than $41,000 in restitution to Social Security and will forfeit more than $26,000 to the government.
