BIRMINGHAM, AL (WBRC) - A preliminary hearing takes place Thursday for a man accused of robbing and killing a convenience store clerk. The hearing will have Judge Katrina Ross decide whether or not there is enough evidence to let the case go before a grand jury.
Prosecutors say surveillance video shows Willy Deon Brown shot and killed Don Patel at the Jet Pep in Forestdale on September 12th. The video shows a suspect enter the gas station, follow Patel into a storeroom and shoot him before taking the cash out of the register. Another piece of video shows a white Chevy Caprice leaving the scene.
Police say they have been able to connect Brown to the case along with a second suspect, Robert Mitchell, Jr.
Brown's attorney says all of the evidence in the case is circumstantial. He feels that it is not enough to send the trial to a grand jury.
