Birmingham City Schools being sued over student macing

BIRMINGHAM, AL (WBRC) - The Birmingham City School System is being sued. The system, along with Superintendent Craig Witherspoon, has been named in a suit filed by the Southern Poverty Law Center.

The lawyers claim too many students are routinely maced by police in Birmingham City schools. The suit argues that it is unconstitutional and claims the practices by the resource officers are hurting the students' ability to get an education.

LaTonya Stearns is the mother of two students who were allegedly maced and is a part of the class action lawsuit. "She wasn't a danger to herself or anybody else. It was completely unjustified," said Stearns. "When my younger daughter saw her sister being maced, she ran and helped her, she too was exposed to mace."

We contacted the Birmingham City School System to get a comment from Superintendent Witherspoon, but have not yet heard back from him yet.
