Struggle for those pro and con of Five Points' eatery continues

BIRMINGHAM, AL (WBRC) - After Chik-Fil-A's plans were denied last month by Birmingham's Design Review Committee, attorneys for Chick-Fil-A appealed.  The hearing was Wednesday. And after asking lots of questions, committee members didn't make a decision about the appeal.

Representing the restaurant, attorney Charlie Beavers says he doesn't think the DRC has legal rights to deny a restaurant because of a drive-thru.  The drive-thru was the crux of neighbors' opposition of the restaurant.

Dozens showed for Wednesday's meeting to say Chick-Fil-A would consort with the area and its addition would hinder traffic.

The Appeals Committee meets Friday, 8:30am at Birmingham City Hall.
