BIRMINGHAM, AL (WBRC) - It's another setback for Jefferson County and its occupational tax.
Late Wednesday, Montgomery County Circuit Judge Charles Price refused to dismiss the lawsuit challenging the county's new occupational tax. Jefferson County attorneys claimed the suit should be tossed out of court because the plaintiffs did not present a claim first to the Jefferson County Commission.
Lawyers challenged the new tax saying the state legislature did not go about approving the tax properly. If Jefferson County loses the lawsuit, commissioners say it will throw the county in another financial crisis.
