2nd mistrial declared in Kayla Fanaei murder

BIRMINGHAM, AL (WBRC) - A mistrial was declared Wednesday in the murder trial of Maurice McCarty, the second time a mistrial has been declared in the murder case of UAB student Kayla Fanaei.

The judge declared a mistrial Wednesday afternoon in McCarty's case. McCarty was on trial for shooting and killing Fanaei in October 2007.

McCarty first went on trial in August 2009, but a mistrial was declared in that case on September 1, 2009, after jurors failed to reach a verdict.

Fanaei, 20, was found dead in her car in the parking lot of Glen Iris Elementary School near the UAB campus in October 2007. Investigators believe McCarty and three others attempted to rob Fanaei, then shot and killed her.
